This privacy policy sets out how NCE Pty Ltd (ABN 97 105 213 045) trading as HOMEandRV  (NCE, we, us and our) uses and protects any personal information that we manage about you. We recognise the importance of your privacy and understand your concerns about the security of the personal information you provide to us. We comply with the Australian Privacy Principles (APPs) as contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs detail how personal information may be collected, used, disclosed, stored and destroyed, and how an individual may gain access to or make complaints about the personal information held about them.  

We are committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Definitions

 

Personal information” generally includes information or an opinion about an identified individual, or about an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

 

Sensitive information”, a sub-set of personal information, is information or an opinion about an individual’s racial or ethnic origin, political opinions, political association membership, religious beliefs or affiliations, philosophical beliefs, professional or trade association membership, trade union membership, sexual orientation or practices or criminal record, and includes health information, genetic information, biometric information and biometric templates.

 

What we collect

 

We collect a variety of personal and sensitive information from you or about you which relates directly to our business functions and activities. The information we collect will vary depending on how and why we interact with you.

 

We may collect the following information:

  • name and job title
  • contact information including email address and phone number
  • postal and billing addresses
  • payment details (eg, credit card account)
  • demographic information such as postcode,
  • preferences and interests (if provided, not mandatory)
  • other voluntary information relevant to customer surveys and/or offers

 

What we do with the information we gather

 

We aim to collect personal information only directly from you, unless it is unreasonable or impracticable for us to do so. For example, we collect personal information in a number of ways including:

  • directly from you, from correspondence that you submit to us, meetings and interviews with us, telephone calls with us, the instructions you provide to us, submissions you make on our websites, registering for or participating in our loyalty program, social media interactions and registration and feedback forms you may fill in for marketing-related activities and events;
  • directly from you, from enquiries about or purchases of our goods and services that you make on your NCE account or via our Home&RV e-store;
  • about your attendance at and participation in our events and activities;
  • from and related to your engagement with us;
  • via our website, when you subscribe to receive emails or newsletters;
  • through images and recordings.

 

In many cases, we require this personal information to understand your needs and to complete the transaction you have entered into.  For example, we need your name, contact details and payment details in order to fulfil your orders placed, and for our internal record keeping.

 

In other cases, we consider that your provision of your personal information will provide you with a better service, and in particular for the following reasons:

  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email or phone.

 

We may use the information to customise the website according to your interests. You can be anonymous or use a pseudonym when dealing with us, unless:

  • the use of your true identity is a legal requirement; or
  • it is impracticable for us to deal with you on such basis.

Why do we collect, hold, use and disclose personal information?

 

We collect, hold, use and disclose personal information from you or about you where it is reasonably necessary for us to carry out our business function and activities, and to provide our goods and services. We use and disclose your personal information only for the purposes for which it was collected or for any other purpose that is otherwise directly related to our functions or activities or otherwise permitted by law. Where we wish to use or disclose your personal information for other purposes, we will ask for your consent.

 

If we do not collect, hold, use or disclose your personal information, or if you do not consent to the provision of such information, then we may not be able to answer your enquiry, complete the goods or services you require, or facilitate participation in any of our services, events and/or activities.

 

We may disclose your personal information to:

  • professional advisors including our accountants, auditors and lawyers;
  • our contractors and third party service provider partners;
  • our insurers;
  • government departments and regulatory authorities; and/or
  • those permitted by law.

 

Under the Privacy Act and under an emergency declaration, we may be asked or required to share and/or handle a limited amount of personal information to prevent or reduce the risk of harm in an emergency or disaster that affects Australians either in Australia or overseas. We will do so in accordance with the Privacy Act, and the particular conditions of the relevant declaration.

 

Overseas Disclosure

 

We are from time to time affiliated with or use the services of other businesses / organisations / people located overseas. For example, some of our IT systems are hosted “in the Cloud”, and some of our contractors are part of multi-national groups. We will only disclose your personal information to overseas recipients where:

  • it is necessary to complete the transaction you have entered into; and
  • you have provided consent; or
  • we believe on reasonable grounds that the overseas recipient is required to deal with your personal information by enforceable laws which are similar to the requirements under the APPs;
  • the country has been listed by the Australian Government as a “white listed” country that provides substantially similar privacy protections; or
  • it is otherwise permitted by law.

 

We are likely to disclose the personal information that we collect and hold about you to third parties located outside Australia — including in the United States of America, Canada, the United Kingdom, the Netherlands, India, Singapore, New Zealand, Germany, France, Ireland, Japan, and other jurisdictions where our service providers operate — for one or more of the purposes set out in this policy (e.g. to provide you with the goods or services you have purchased). Some of these jurisdictions may have privacy and data protection laws that are less protective than those in Australia.

 

Direct Marketing

 

We may contact you to provide you with information about other services offered by us that may benefit you, and for purposes associated with the operation of our loyalty program. When we contact you, it may be via mail, telephone, or email. If you do not wish to receive marketing materials from us, you can contact us at any time to advise of this at the contact details provided in this policy. When you contact us to make this request, we will action your request within five (5) working days. Opt-out procedures will also be included in all our marketing and promotional communications.

 

Security

 

We are committed to taking reasonable steps for ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, technical, organisational, procedural, electronic and managerial procedures to safeguard and secure the information we collect. For example:

  • data held and stored on paper is stored in a secure premises with monitored alarms.
  • data held and stored electronically is protected by internal and external firewalls, high encryption and all access to electronic data including databases requires password access.

 

Destruction and De-identification

 

We will retain your personal information whilst it is required for any of our business functions, or for any other lawful purpose by taking reasonable steps including technical and organisational measures.

 

We will also retain your personal information for the time periods required by law (commonly, seven years).

 

We use secure methods to destroy or to permanently de-identify your personal information when it is no longer needed. For example:

  • paper records are sent for secure destruction. In some instances, paper records and original transaction documents will be returned to you and/or relevant third parties.
  • electronic records retained for longer than 7 years may be archived to alternative storage and are subject to the procedural safeguards described above.

 

How we use cookies

Automated Decision Making

 

There may be limited cases where we use your personal information through our automated decision making platforms to make a decision which may affect your rights or interests, or which are used to assist substantially and directly in making that decision.

 

We may use automated decision platforms to substantially and directly assist with the following types of business decisions:

  • Personalised Marketing & Behavioural Profiling
  • Fraud Detection & Risk Scoring
  • Credit or Payment Eligibility Checks
  • Inventory & Order Fulfillment Decisions

 

Some of the above types of decisions are primarily made solely through the use of automated decision platforms (eg, credit checks and fraud detection).  We will only intervene in these automated processes where flags or triggers are raised.

 

The types of personal information that we may use in automated decision making platforms include name, address, date of birth, age, gender, language preferences, email, phone number, credit history and credit score, income or employment details (if relevant), browsing history, purchase history, location data (IP-based or GPS), device type, account activity patterns, purchase history and repayment behaviour and shipping address.

 

Controlling your personal information

 

You may choose to restrict the collection or use of your personal information in the following ways:

  • whenever you are asked to fill in a form on the website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes
  • if you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us.

 

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

We will share your personal information in the case of arranging and completing a sale of our business or assets.

Request for access and correction

 

We take reasonable steps to ensure that the personal information we use or disclose is accurate, complete and up to date, having regard to the purpose of the use or disclosure.

 

We also have procedures in place for dealing with and responding to requests for access to, and correction of, the personal information held about you. Your right to request access may arise under the Privacy Act.

 

In most cases, we expect that we will be able to comply with your request. However, if we do not agree to provide you access or to correct the information as requested, we will give you written reasons why. For further information, please contact our Privacy Officer.

 

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible at the above address. We will promptly correct any information found to be incorrect.

 

Data Breaches

 

If we suspect that a data breach has occurred, we will undertake an assessment into the circumstances of the suspected breach within 30 days after becoming aware of the occurrence of the suspected breach. Where it is ascertained that a breach has actually occurred and where required by law, we will notify the Privacy Commissioner and affected individuals in accordance with our legal requirements.

 

Under the Privacy Act and under an eligible data breach declaration, we may be asked to share and/or handle a limited amount of personal information to prevent or reduce the risk of harm to individuals whose personal information has been breached. We will do so in accordance with the requirements of the Privacy Act, and the particular conditions of the relevant declaration.

 

Complaints and Concerns

 

We have procedures in place for dealing with complaints and concerns about our practices in relation to the Privacy Act, and any alleged breach of this Policy. We will respond to your complaint in accordance with the relevant provisions of the APPs. For further information, please contact our Privacy Officer.

 

We always want to have the first opportunity to resolve your complaint.  If we are unable to resolve your privacy complaint, you have other options to escalate your complaint. This includes lodging a complaint with:
